Terms and Conditions
1. General
These Terms and Conditions apply to all bookings for live musical performances and all purchases of music books supplied by Alan Oliver
By making a booking or purchasing a product, the Client agrees to these Terms and Conditions.
2. Performance Bookings
2.1 Booking Confirmation
A performance booking is only confirmed once a deposit has been received and written confirmation has been issued by the Musician.
2.2 Deposits
All deposits paid for performances are strictly non-refundable.
The deposit secures the date and compensates the Musician for turning away other work. No refunds will be given in the event of cancellation by the Client, regardless of the reason.
2.3 Balance Payment
The remaining balance must be paid no later than [7/14/30] days before the performance date unless otherwise agreed in writing.
Failure to pay the balance by the due date may result in cancellation of the booking, with the deposit remaining non-refundable.
2.4 Client Cancellation
If the Client cancels a confirmed booking:
The deposit will be forfeited and is non-refundable.
If cancellation occurs within [30] days of the event date, the full booking fee may become payable.
Any amounts already paid beyond the deposit may be refunded at the Musician's discretion unless the event falls within the cancellation period stated above.
2.5 Changes to Booking
Any changes to the event date, venue, performance times, or other material details must be requested in writing and are subject to availability and agreement by the Musician.
A requested date change may be treated as a cancellation and a new booking if the Musician is unavailable for the new date.
2.6 Musician Cancellation
In the unlikely event that the Musician is unable to perform due to illness, accident, emergency, or circumstances beyond reasonable control, every effort will be made to provide a suitable replacement musician.
If no replacement can be provided, all monies paid by the Client, including the deposit, will be refunded in full. This shall be the Client's sole remedy.
2.7 Venue Requirements
The Client is responsible for ensuring:
Safe access to the venue.
Adequate performance space.
Access to electrical power where required.
Compliance with any venue regulations.
The Musician reserves the right to refuse to perform where conditions are unsafe or unsuitable.
2.8 Force Majeure
The Musician shall not be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to extreme weather, natural disasters, government restrictions, power failures, strikes, or other unforeseen events.
3. Music Book Sales
3.1 Orders and Payment
Full payment must be received before any music book is dispatched, delivered, or provided.
3.2 Non-Refundable Payments
All payments made for music books are strictly non-refundable.
No refunds, exchanges, or credits will be provided once an order has been placed, except where required by applicable consumer law.
3.3 Digital Products
Where music books are supplied electronically or by digital download, no refunds will be provided once access has been granted or the product has been delivered.
4. Liability
The Musician's total liability for any claim arising from a booking, performance, or product purchase shall not exceed the amount paid by the Client.
The Musician shall not be liable for indirect, incidental, or consequential losses.
5. Photography and Promotion
Unless otherwise agreed in writing, the Musician may use photographs, videos, testimonials, or reviews from the event for promotional and marketing purposes.
6. Governing Law
